These Terms and Conditions (“Terms”) govern the use of the website https://tixort.au (“Website”) and the ticketing services provided by Tixort Pty Ltd (“Tixort”, “we”, “us”, or “our”). By accessing our Website or using our services, you agree to be bound by these Terms.
1. Use of Services
Tixort provides a platform for event organisers to list and promote events, and for customers to purchase tickets to those events. Tixort is not the promoter or organiser of the events listed on the platform unless explicitly stated.
2. User Responsibilities
- You agree to use the Website lawfully and in accordance with these Terms.
- You must provide accurate and complete information when registering or purchasing tickets.
- You are responsible for safeguarding your account credentials and any activity under your account.
3. Event Organiser Obligations
If you are an Event Organiser using the Tixort platform to sell tickets, you agree to:
- Provide accurate, up-to-date, and lawful information about your event.
- Ensure your event complies with all relevant laws, permits, safety obligations, and local council or venue requirements.
- Fulfil all obligations to ticket holders, including entry, safety, and service standards.
4. Cancellation and Refund Policy
Tixort facilitates ticket refunds only in accordance with the following terms:
- In the event of cancellation or rescheduling, the Event Organiser must immediately reimburse all customer refunds processed by Tixort, including platform and payment processing fees already incurred.
- If funds have been withdrawn prior to cancellation, the Event Organiser must return the full withdrawn amount to Tixort within five (5) business days.
- Refunds must be processed promptly to protect customer interests.
- Tixort reserves the right to pause or stop ticket sales if refund obligations are breached.
5. Financial Safeguards & Refund Obligations
- If the Event Organiser withdraws ticket proceeds before the event and the event is later cancelled for any reason, the Event Organiser must return the full withdrawn amount to Tixort within five (5) business days.
- Both Tixort and the Event Organiser must reconcile and settle all outstanding financial matters within five (5) business days following the conclusion of the event.
- If the event is cancelled, the Event Organiser must pay Tixort an agreed operating cost (to be settled by both parties) to cover administrative expenses.
6. Customer Refunds
All tickets sold through Tixort are non-refundable unless:
- The event is cancelled, rescheduled, or significantly changed.
- Australian Consumer Law entitles the customer to a refund.
Refunds will be processed to the original method of payment. Tixort is not responsible for delays caused by banks, payment processors, or organisers failing to return funds in time.
7. Intellectual Property
All content on the Tixort Website, including branding, text, images, software, and logos, is the property of Tixort or its licensors. You may not reproduce, distribute, or use any content without prior written consent.
8. Limitation of Liability
Tixort provides a ticketing platform and does not guarantee the quality, safety, or conduct of any event listed on our Website. We are not responsible for:
- Event cancellation, changes, or failure to deliver by organisers
- Acts of third-party service providers
- Loss or damage resulting from misuse of the Website
To the fullest extent permitted by law, our liability is limited to the amount paid by you for the ticket(s) or service(s) in question.
9. Legal & Compliance
- Both parties agree to comply with all applicable Australian laws and regulations, including the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth).
- This Agreement is governed by the laws of Victoria, Australia.
- Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Victoria.
10. Amendments
Tixort may update these Terms at any time. Updated versions will be posted on our Website with the revised effective date. Continued use of the platform after changes constitutes acceptance of the updated Terms.
